Amendments to the Act
11 Paragraph (a) of the definition offence in section 183 of the Criminal Code is amended by adding
the following after subparagraph (liii):
(liii.01) section 320.1001 (offence motivated by hatred),

12 Paragraph 264(4)(a) of the Act is replaced by the following:
(a) the terms or conditions of an order made under section 161 or a recognizance entered into under
section 810, 810.012, 810.1 or 810.2; or
2019, c. 25, s. 120
13 Subsection 318(1) of the Act is replaced by the following:
Advocating genocide
318 (1) Every person who advocates or promotes genocide is guilty of an indictable offence and liable to
imprisonment for life.
14 (1) Paragraph 319(1)(a) of the Act is replaced by the following:
(a) an indictable offence and is liable to imprisonment for a term of not more than five years; or
(2) Paragraph 319(2)(a) of the Act is replaced by the following:
(a) an indictable offence and is liable to imprisonment for a term of not more than five years; or
2022, c. 10, s. 332(1)
(3) Paragraph 319(2.1)(a) of the Act is replaced by the following:
(a) is guilty of an indictable offence and liable to imprisonment for a term of not more than five years; or
(4) Subsection 319(7) of the Act is amended by adding the following in alphabetical order:
hatred means the emotion that involves detestation or vilification and that is stronger than disdain or
dislike; (haine)
(5) Section 319 of the Act is amended by adding the following after subsection (7):
Clarification
(8) For greater certainty, the communication of a statement does not incite or promote hatred, for the
purposes of this section, solely because it discredits, humiliates, hurts or offends.
15 The Act is amended by adding the following after section 320.1:
